Common Causes of Lyft Accidents in Los Angeles
- Driver negligence: This may include a violation of any traffic law or driving distracted.
- Negligence by a ridesharing company: an inadequacy in background checks or hiring unqualified drivers.
- Insufficient vehicle maintenance: Most of the drivers cannot afford to invest money in maintaining their vehicles.
- Driver fatigue: Driver is at fault due to working long shifts or late.
Who Is Liable in Lyft Accident?
After a rideshare accident you may be wondering who is liable for Lyft accident. Liability in Lyft accidents is not easy to prove since there might be multiple parties involved as well as multiple insurance companies. Most common responsible parties for rideshare accidents are:
- Lyft Driver: For negligent driving or malfunction of their vehicle.
- Lyft Company: If the accident occurred either during the ride Lyft driver had accepted or if there are any negligent hiring or maintenance of vehicle.
- Other Drivers: Causing the accident when the Lyft driver or passenger was on the road.
- Passengers: When their actions distracted or otherwise interfered with the driver.
- Pedestrians or Bicyclists: If their negligence was the cause of the accident.
- Government Agencies: Most often due to the road conditions or malfunctioning traffic lights.
- The manufacturers of the vehicles or mechanics may also be held liable for any defects and poor maintenance of the vehicle.
A well-seasoned Lyft accident attorney at Bojat Law Group will be able to find out who is liable for your injuries and ensure that the correct party is taken into account and that they pay for your damages, both economic and non-economic.
Lyft Insurance Coverage
Lyft provides its drivers and riders with a system of insurance coverage that depends on the ride status. It changes based according to whether or not the driver is offline, logged in but awaiting a ride, on the way to pick up a passenger, or transporting a passenger.
Here’s a breakdown of the insurance provided by Lyft at each part of the ride process:
Driver Offline (Not Logged into App)
Lyft offers no coverage while a Lyft driver is offline or not using the app. The driver uses the vehicle for personal reasons, and his/her personal auto insurance policy is the only coverage that applies. If an accident occurs while the driver is offline and not logged into the app, he/she will be liable for the damages, and his/her personal policy must cover the accident.
Driver Online in the App but Has Not Accepted a Ride
In the case of a driver is logged onto the Lyft application but has not accepted a ride, Lyft provides contingent liability insurance. It means that in the case of a claim when the driver’s personal insurance is insufficient, then Lyft insurance will cover the full amount. Lyft coverage at this stage includes:
- $50,000 for bodily injury per person.
- $100,000 for bodily injury per accident.
- $25,000 for property damage.
However, the driver’s personal auto insurance must first be used before Lyft’s insurance is activated. In case of denial from a personal policy or being underinsured, then Lyft’s contingent coverage kicks in.
Driver Accepted a Ride or Is Transporting a Passenger
The full commercial insurance policy of Lyft is activated if a driver has accepted a ride or has a passenger in the vehicle. This is the point at which Lyft offers the highest level of protection, including:
- $1 million in liability insurance covers injuries and damages to passengers, other drivers, pedestrians, and property when the Lyft driver is at fault for an accident.
- $1 million uninsured/underinsured motorist coverage: for cases when another driver is at fault, either not having enough insurance or no insurance at all. In this instance, if the at-fault driver’s policy is too small, Lyft’s coverage would pay for the injuries and damages.
- Comprehensive and collision coverage: If the driver has comprehensive and collision coverage through their personal policy, Lyft will provide up to the cash value of the vehicle for damages, but this coverage comes with a $2,500 deductible.
Driver in an Accident with No Ride Accepted
Contingent liability coverage applies when a Lyft driver is in the app but has not accepted a ride request. This can, however, be a gray area, and can cause confusion especially with multiple apps on. In this case, Lyft will cover bodily injury and property damage but only after the driver’s personal insurance is used.

Frequently Asked Questions
After a Lyft accident, your first priority is safety. Ensure that everyone involved is safe and call 911 if there are injuries. Get medical help even if you think you are uninjured, as some injuries can be delayed. Take photos of the accident scene, collect contact information from the driver and any witnesses, and file a police report.
If another driver caused the accident, their insurance will be responsible for covering damages. However, if they are uninsured or underinsured, Lyft’s uninsured/underinsured motorist coverage (up to $1 million) will cover your injuries and damages.
You may be able to file a lawsuit against Lyft if the company was negligent, such as failing to properly screen or train drivers. However, since Lyft classifies drivers as independent contractors, suing Lyft directly can be challenging unless company negligence is involved. Consulting with an experienced Lyft accident lawyer is essential to understanding your legal options.
You may be eligible for compensation to cover:
- Medical bills and treatment costs (current and future).
- Lost wages if your injuries prevent you from working.
- Property damage to your vehicle or personal belongings.
- Pain and suffering, including emotional distress and trauma.
- Loss of earning capacity if you are unable to return to your previous job due to your injuries.
In California, you typically have two years from the date of the accident to file a personal injury claim. This is known as the statute of limitations. Failing to file within this time frame may result in losing your right to seek compensation.
If you were a pedestrian or cyclist hit by a Lyft driver, the same insurance policies apply. If the driver was logged into the app or on an active ride, Lyft’s insurance would cover your injuries and damages. If the driver was not logged into the app, the driver’s personal insurance would be responsible.
If Lyft’s insurance company contacts you after an accident, avoid giving detailed statements until you’ve spoken with an attorney. Insurance adjusters may try to minimize your claim or get you to settle for less than you deserve. An attorney can handle communication with the insurance company on your behalf
The timeline for settling a Lyft accident claim can vary based on the complexity of the case, the severity of your injuries, and the negotiations with the insurance companies. Some claims may settle in a few months, while others that involve disputes or require litigation may take longer.
