What Is Mitigation Of Damages

Under California law a person who has suffered injuries from another person negligence or wrongful conduct has a duty to take reasonable steps to minimize the damages they have suffered. This principle is used in personal injury, breach of contract and other civil claims, to prevent the damages from being increased as a result of the laziness or unreasonable behavior of the plaintiff and it is called – mitigation of damages. The purpose of this rule is to prevent the plaintiff from being rewarded for inaction, while at the same time ensuring that the defendant is only liable for actual and unavoidable losses. What Is a Duty To Mitigate Damages

In personal injury cases, the duty to mitigate damages is the legal duty of the plaintiff to take reasonable steps to reduce the consequences of their injuries according to CACI No. 3930. This includes, for example, seeking medical help in a timely manner, adhering to therapies recommended by doctors and avoiding activities that could worsen the condition. This obligation is not just moral or practical, but is legally binding and directly affects the court’s decision on the amount of damages.

In Which Personal Injury Lawsuits Is Mitigation Of Damages Applicable

Mitigation of damages applies in various areas of personal injury law, where the injured party has an obligation to take reasonable steps to reduce the damage or consequences of the injury. These are the key areas:

Example From a Traffic Accident

Imagine that Anna was injured in a car accident in Los Angeles because another driver was negligent. Anna has injured her knee, but she decides not to go to the doctor right away, thinking that the injury will “go away on its own”. Over the next few weeks the injury worsens, and when she finally sees a doctor, she needs an operation that might have been avoided if she had sought medical help immediately.

In this case, the court could consider that Ana had failed in her duty to mitigate the damage by not seeking appropriate medical attention immediately. As a result the court may reduce the damages that Anna can receive from the driver responsible for the accident.

Let’s say the cost of the surgery is $50,000, but early medical intervention would cost only $5,000. The court could decide that Ana receives only $5,000 in medical expenses because the worsening of the injury could have been avoided if Anna hadn’t failed to mitigate damages.

Defendant’s Burden of Proof in Mitigation Cases

How does the defendant prove that the plaintiff failed the duty to mitigate damages? In this process the defendant has the burden of proof to show that the plaintiff (the injured party) failed to take reasonable steps to reduce their losses. This burden requires the defendant to provide evidence that:

  • Mitigation was possible: The plaintiff could have taken specific, reasonable actions to avoid or minimize the harm.
  • The plaintiff failed to act reasonably: The plaintiff’s inaction or decisions were not in line with what a reasonable person in similar circumstances would have done.
  • Damages could have been reduced: The plaintiff’s failure to mitigate resulted in avoidable additional damages.

Why Mitigation of Damages Matters in Property Damage Lawsuits

Mitigation of damages is a key legal principle in property damage cases, as it helps ensure fairness and balance liability between plaintiff and defendant. This principle requires that the injured party, or property owner, take reasonable steps to reduce additional damage or loss after the damage has been done. The application of mitigation means that the plaintiff cannot seek compensation for damages that could have been avoided with reasonable effort or expense. According to California Civil Jury Instructions (CACI) 3931, a plaintiff is not entitled to recover compensation for property damage that they could have avoided through reasonable efforts or expenditures.

Example: Imagine that you own an apartment that you rent out. The tenant calls you and reports a leaking bathroom pipe. As a responsible property owner, you immediately call a plumber to fix the pipe and prevent further leaks. You keep a bill for repairs and document damage to photographs. By doing this you fulfill your duty to mitigate damages.

If on the other hand you ignore leaks for days, let the water destroy the tiles, walls, and flooring in the apartment below, you failed your duty to mitigate damages. If you then try to sue the tenant for the damages, the court will say that you could have prevented most of the damage by reacting quickly and will reduce the amount of compensation awarded. The landlord retains the right to sue, but the failure to mitigate damages may significantly reduce the amount of compensation they can recover.

5 Common Mistakes Injury Victims Make When Trying to Mitigate Damages

  1. Waiting too long to seek any treatment
  2. Not documenting mitigation efforts
  3. Ignoring doctor’s advice
  4. Choosing treatments that might worsen the condition
  5. Not communicating with insurance companies about treatment plans

Judicial Practice in California

California courts define reasonableness in mitigation through several important precedents:

Green v. Smith (1968): Mitigation must be reasonable according to the circumstances at the time the damage occurred, without the use of hindsight.

Valle de Oro Bank v. Gamboa (1994): The plaintiff is not required to waive important rights in order to mitigate damages.

Shaffer v. Debbas (1993): Mitigation efforts must not be disproportionate and excessive.
