Orange County Bicyclist Killed in Suspected DUI Crash

A tragic collision in Santa Ana claimed the life of 39-year-old bicyclist Andrew Rodriguez after a driver allegedly under the influence struck him near Grand Avenue and Fairhaven Avenue late on August 27, 2025, according to Santa Ana Police. The driver, identified as 26-year-old Vanessa Anahi Picenavalos, was arrested on suspicion of DUI. The investigation is ongoing. In this blog, read how you can protect your rights when a life is wrongfully taken and what steps families in Orange County can take after a fatal accident.

Who can be held responsible in a fatal DUI bicycle crash

Alcohol-impaired driving remains one of the deadliest problems on California roads, with 1,355 alcohol-involved traffic deaths recorded in 2023. In Orange County alone, 1,966 people were killed or injured in alcohol-related crashes in 2022, and in Santa Ana that same year, there were 126 alcohol-involved victims and 105 bicyclist victims. These numbers show just how often impaired drivers put cyclists and pedestrians at risk and they also explain why identifying every potentially responsible party is critical in a wrongful death claim. Accountability in these tragedies most often falls on:

The at-fault driver. In nearly every case, the impaired driver is the primary defendant. A civil claim can pursue damages against the driver and their insurance carrier.

The vehicle owner. If someone other than the driver owns the car, California’s permissive use law allows liability to extend to that owner, though subject to statutory caps. If the owner negligently entrusted the vehicle—for example, loaning it to someone they knew was intoxicated—liability can expand beyond those limits.

Bars or social hosts. Unlike some states, California limits liability for those who serve alcohol. A civil claim is possible only in narrow situations, such as when an establishment serves an obviously intoxicated underage patron who later causes injury or death.

Your legal options after a fatal bicycle collision

Wrongful death claim. Surviving family members can bring a wrongful death action to recover economic and non-economic losses caused by another’s wrongdoing. In California, most wrongful death claims must be filed within two years of the date of death. Missing this deadline can end the claim.

Survival action. The decedent’s estate may also bring a survival action for certain losses the person suffered before death, such as medical expenses or property damage, when supported by evidence. This often proceeds alongside a wrongful death claim.

Insurance claims. Multiple coverages can apply, including the at-fault driver’s liability policy and possibly the vehicle owner’s policy. If the at-fault driver is uninsured or underinsured, families may look to the victim’s own UM or UIM coverage if available.

What families can do

  1. Preserve evidence. Save photos, videos, medical and funeral records, and any communications with insurers.
  2. Document the crash location. Note traffic controls, lighting, lane design, and any visibility issues around Grand and Fairhaven. This intersection has been specifically referenced by local reports. BikinginLA
  3. Avoid early recorded statements. Speak with counsel before giving detailed statements to insurance adjusters.
  4. Request the traffic collision report and any supplemental reports once they become available.
  5. Consult an attorney who handles wrongful death and bicycle cases in Orange County to coordinate with investigators, protect timelines, and value the claim accurately.

Compensation families can seek after a wrongful death

  • Economic losses such as funeral and burial costs, the value of financial support the decedent would have provided, and the loss of household services
  • Non-economic losses including loss of love, companionship, comfort, care, assistance, protection, affection, society, and moral support
  • Survival damages when supported by evidence, such as medical bills incurred before death

Every case is different. The available recovery depends on liability facts, available insurance limits, and the quality of evidence supporting the family’s losses.

Safety notes for the community

Although responsibility rests with impaired drivers, families and advocates often ask what might prevent similar tragedies. On corridors like Grand Avenue, visibility, lighting, and the lack of protected bicycle infrastructure can increase risk for people on bikes. Community reporting and targeted improvements at known danger points can save lives.

If you witnessed this crash or have additional information, Santa Ana Police asked the public to contact Detective K. Briley at 714-245-8215 or the Traffic Division at 714-245-8200.
