Madera County Crash with Big Rig Leaves Three Children Dead

Three children were killed Saturday evening when a family’s minivan crashed into a semi-truck at the intersection of Avenue 7 and Road 24, according to the California Highway Patrol. Investigators say the 45-year-old mother who was driving the minivan did not stop at a posted stop sign before entering the intersection. The impact split the van and pushed the big rig into a nearby canal.

A 17-year-old girl, her 15-year-old brother, and their 6-year-old sister all lost their lives in the collision. Their mother, who was driving the van, and another passenger were hospitalized with major injuries. The truck driver was also injured but is expected to recover. CHP has stated that the driver of the minivan could face criminal charges as the investigation continues.

Do you have to stop completely at a stop sign in California?

Yes. California Vehicle Code § 22450 requires a full stop at the limit line (or before the crosswalk/intersection if no line is marked). Rolling stops are illegal. After stopping, § 21802 requires drivers to yield the right-of-way to vehicles that are in the intersection or approaching so closely as to be an immediate hazard and to continue yielding until it’s safe to proceed.

That said, fault in these cases is rarely black and white. Investigators will also examine:

  • Visibility issues: Was the stop sign properly placed and unobstructed?
  • Roadway design: Did the layout of the intersection make it difficult to see approaching traffic?
  • Truck factors: Was the semi speeding, overloaded, or otherwise unable to stop in time?
  • Environmental conditions: Could sun glare, poor lighting, or weather have contributed?

Under California’s comparative negligence rule, more than one party can share responsibility for a crash. Even if a driver clearly ran a stop sign, other contributing factors may affect how liability is ultimately assigned. A Madera car accident lawyer at Bojat Law Group can help evaluate all these details and determine how liability should be divided.

Safety reminder for rural intersections

Intersections controlled by stop signs on high-speed rural roads are among the region’s most dangerous. Drivers approaching these crossings should reduce speed early, scan left and right twice, and avoid assumptions about an oncoming truck’s distance or closing speed. Large trucks require more time and distance to stop and can create catastrophic forces in a side-impact crash.

How a stop-sign violation affects civil liability

When a driver violates a safety statute (like § 22450/§ 21802) and causes injury, California’s negligence per se rule can create a presumption of negligence if certain conditions are met (the statute protects this class of persons from this type of harm, the violation caused the injury, etc.). That presumption can be rebutted, but it shifts the burden to the violator to show a legally valid excuse. Consulting a car accident lawyer after such a crash can help victims understand how negligence per se applies to their case.

Surviving passengers can file claims even against a family member

California law recognizes that every injury victim has the right to seek compensation, regardless of who was driving. When the at-fault driver is a parent or another family member, civil claims can still be made against that driver’s auto insurance policy. This means surviving passengers in the minivan even the mother’s own children or relatives may bring personal injury claims for medical expenses, pain and suffering, and long-term care.

While these cases are emotionally difficult, the claims are directed at the insurance company, not the family member personally. The law is designed this way to protect victims and ensure that coverage is available for their recovery, even when the at-fault driver is someone close to them.

Fatal crashes like this remind us how quickly lives can change. California law gives surviving family members the right to pursue wrongful death and injury claims, even when the at-fault driver is a loved one. Having an experienced Madera personal injury lawyer on your side ensures that evidence is preserved, deadlines are met, and your family’s rights are protected.
