Can the At-Fault Driver Sue You After Settlement?

You finally settle your car accident claim. The calls stop. The paperwork is signed. Then a new worry hits: can the at fault driver sue you after settlement? In most California cases, the practical answer is no, because a properly drafted settlement includes a release of liability that closes the door on future claims tied to the crash. But there are a few real world exceptions that can surprise people, usually when the settlement paperwork is one sided, incomplete, or only covered part of the dispute.

Below is how this typically works in California, and what to do if you are being threatened with a lawsuit after you thought everything was done.

The release controls what the settlement covers

An insurance settlement usually requires a signed release of liability. That release is meant to end the accident claim in exchange for settlement funds. Many releases also include language that waives protections for unknown claims under California Civil Code section 1542, which is why a signed release can cut off later arguments about new symptoms or new medical expenses discovered after the fact.

So if your settlement agreement is clear and enforceable, the at fault party generally cannot come back later and successfully file a lawsuit against you over the same accident.

Can the other driver sue me after we settled?

Usually, the at fault driver cannot sue you after a settlement if the settlement included a valid release that covers the at fault driver and the accident related claims. A signed release is designed to end the dispute for good.

The key word is release. Not every “settlement” closes every possible claim. Some payments resolve only property damage. Some releases protect only one side. Some agreements release the insurance company but not the driver personally. The details matter.

When the at fault driver might still sue after settlement

Most of the time, the release shuts things down. But here are the situations where further legal action can be more than a bluff.

1. The settlement only resolved property damage, not bodily injury

Sometimes people settle the car repair portion of a car accident case quickly, then later face a new dispute about injury, medical treatment, or lost wages. If the documents were limited, a later injury claim might not be barred.

2. The release did not clearly cover the right people

Your release form should identify who is released. If the accident involved multiple parties such as an owner, employer, rideshare driver, or another defendant, a narrow release can leave gaps. Gaps are where further liability arguments live.

3. Fraud, duress, or a serious contract problem

A settlement agreement is a contract. California law allows rescission in certain cases if consent was given by mistake, or obtained through duress, menace, fraud, or undue influence.

That does not mean a person can casually undo a deal because they changed their mind. It means that if someone can prove they were pushed into signing or deceived, they may try to attack whether the agreement is legally binding. These are rare exceptions, but they are real.

4. Mutual mistake or missing essentials

If the agreement is missing key terms, signatures, or has a defect that makes it unenforceable, a court dispute can follow. A true mutual mistake can also trigger legal options in some contract scenarios, though it is not the normal outcome in routine insurance settlement paperwork.

5. A separate claim was never released

Sometimes the threat is not really about the same accident injury claim. It could involve a different theory or a different party, like a product defect claim against a manufacturer. Whether you can pursue legal action or whether someone can pursue compensation against you depends on what the settlement covers.

What to look for in your settlement agreement

If you are worried about further claims, pull your paperwork and check:

  1. Does the settlement agreement say it resolves the entire accident claim or only part of it
  2. Does the release of liability name the at fault drivers, the insurance company, and any other liable party involved
  3. Is it a mutual release or one directional
  4. Does it include a Civil Code 1542 waiver that can impact unknown future medical costs and future expenses
  5. Does it specify that it is a legally binding contract and a final settlement of current and future expenses

If you do not understand the language, that is the moment to call a personal injury lawyer, not after you get served.

What to do if the at fault driver threatens further legal action

If you receive threats or paperwork:

  1. Notify your auto insurer immediately. An insurance claim often triggers a duty to defend under your policy
  2. Do not argue fault in writing. Do not give recorded statements without advice
  3. Save everything: medical bills, medical records, photos, repair estimates, settlement offer letters, and proof of settlement funds received
  4. If served, respond on time. Missing a deadline can create problems even if their case is weak
  5. Get medical attention if you still have symptoms. A medical professional can document the full extent of injuries, including future medical costs, lost earning capacity, and ongoing medical expenses

Talk to an experienced lawyer before you assume you are exposed

In California, a properly written settlement and release usually ends the dispute. Post settlement issues typically arise because the settlement did not resolve the full dispute, did not clearly release the proper parties, or is later attacked on enforceability grounds.

If you are being threatened after a settlement, you do not have to guess or spiral. Our lawyers at Bojat Law Group will review your release of liability, explain what it actually covers, and tell you clearly whether there is any real legal exposure or if the threat is empty. We will also help you understand the next step in the legal process, including what to do if the insurance company or the other side tries to push further claims.
